How to Talk to Your Insurance Company After a Car Crash

The initial response for most people after a car accident is to enlist the help of their insurance company. After all, they’re on your side, right? While going through insurance may get the ball rolling on getting your life back to normal, keep in mind that insurance companies have only one goal — a healthy bottom line at the end of each fiscal year. An insurance company’s entire business is based on collecting as much as they can in insurance premiums and paying out as little as they can on claims.

In fact, those who hire a personal injury attorney following a car crash or other type of personal injury generally receive a fairer settlement than  those who go it alone. The insurance company is well aware of this and takes advantage of those who choose not to hire an attorney.  Some even encourage you not to hire an attorney.

There are several things you should do following a car collision:

  • Pull off the road and out of harm’s way if possible
  • Check for injuries and call 911 for medical assistance if needed.
  • Call the police; those who have a police report will have a much easier time dealing with insurance issues.
  • Exchange insurance information with others involved in the collision: make sure you have the other driver’s basic information as well as the license plate number and the make and model of the vehicle.
  • Get eyewitness statements if possible.
  • Once you are able, write down all the details of the collision you can remember, no matter how minor it seems at the time, including weather conditions, traffic, where it occurred, etc.
  • If you can, take photographs at the scene of the accident.
  • Report the claim to your insurance company, giving them the name of your personal injury attorney at the same time.

Should the other driver’s insurance company call you, be sure to give them the name of your attorney and don’t speak to them without discussing it with your personal injury lawyer.  Don’t go it alone.  Let the attorneys at Shim & Chang help you every step of the way.
