Medical Malpractice is the Eighth Leading Cause of Death

Medical malpractice essentially means that a health care provider was responsible for an injury or death because he or she failed to deliver a reasonable standard of care. Medical malpractice may result from an act itself or from a failure to act. Over 100,000 wrongful deaths throughout the United States occur each year as a direct result of medical malpractice and physician negligence. In fact, medical malpractice is the eighth leading cause of death, with medication and pharmaceutical errors resulting in over a million injuries each year. Medical malpractice claims generally cover the following:

  • Injuries which occur during the birth of a baby
  • Misdiagnosis or delayed diagnosis of disease or prognosis
  • Blood contamination
  • Negligence during a surgical procedure
  • Harm from prescriptions drugs
  • Anesthesia malpractice
  • Surgical errors

In addition and importantly, the patient must be fully informed of any potential risks associated with a medical procedure, a medical device or a medication. Physicians have a duty to advise their patients of alternative procedures and treatments. Should a patient be injured by a failure to obtain informed consent, then a medical malpractice case could be warranted.

Hawaii law gives those injured by a medical procedure, device or medication two years from the date they knew — or should have known — they were injured through medical negligence in which to file a lawsuit. Those who have been the victim of medical malpractice in Hawaii should not have to pay for a doctor’s mistake. The financial burdens and the emotional trauma which result from medical negligence should never be overlooked.  The attorneys at Shim & Chang can help you with your medical negligence claim.
